1. Acceptance of terms

These Terms and Conditions ("Terms") govern your use of the website operated by Akshay Web Development ("Akshay", "we", "us" or "our") and any web design, development, hosting, SEO or maintenance services we provide (the "Services"). By accessing our website, requesting a quote or engaging our Services, you ("Client", "you") agree to be bound by these Terms. If you do not agree, you must not use our website or Services.

2. Services

We provide website design, web development, e-commerce development, web application development, SEO, performance optimisation and ongoing maintenance services. The specific scope, deliverables, timeline and price for each project will be set out in a written proposal, quote or statement of work ("Proposal"). In the event of a conflict between these Terms and a signed Proposal, the Proposal prevails for that project.

3. Quotes and proposals

4. Payment terms

5. Client responsibilities

To allow us to deliver the Services on time, you agree to:

Delays caused by late content or feedback may extend the project timeline and, if substantial, may incur additional fees.

6. Project timeline and revisions

Estimated timelines in a Proposal are provided in good faith and depend on timely Client input. Each package includes a specified number of revision rounds at the design stage. Additional revisions or changes to approved designs are treated as additional work and billed at our standard hourly rate. Projects inactive for more than 60 days due to lack of Client response may be closed, and a restart fee may apply.

7. Intellectual property

8. Third-party services

Websites often rely on third-party services such as hosting, domain registrars, payment gateways, email providers, plugins and APIs. We are not responsible for the availability, performance, pricing changes or policies of third parties. Any fees for third-party services are your responsibility unless included in your plan.

9. Maintenance plans

10. Cancellation and refunds

11. Warranties and disclaimers

We warrant that the Services will be performed with reasonable skill and care. We will fix defects in our code reported within the post-launch support period stated in your package at no charge. Except as expressly stated, the Services and website are provided "as is" without warranties of any kind, express or implied, including fitness for a particular purpose, search engine rankings, sales results or uninterrupted operation.

12. Limitation of liability

To the fullest extent permitted by law, Akshay shall not be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, data, revenue or business opportunity, arising from or related to the Services or your use of the website. Our total liability for any claim shall not exceed the total fees paid by you to us in the 12 months preceding the claim.

13. Confidentiality

Each party agrees to keep confidential any non-public business, technical or financial information disclosed by the other party in connection with the Services, and to use it only for the purposes of the project. This obligation survives the end of our engagement for 2 years.

14. Use of this website

You agree not to use our website for any unlawful purpose, attempt to gain unauthorised access to our systems, introduce malicious code, or copy or reproduce content from this website without our written permission. All content on this website, including text, graphics, logos and code, is owned by or licensed to Akshay and protected by copyright and trademark law.

15. Governing law

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles. Any dispute shall be subject to the exclusive jurisdiction of the courts located in San Francisco, California. The parties agree to attempt in good faith to resolve any dispute through negotiation before commencing legal proceedings.

16. Changes to these terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised "Last updated" date. Changes do not affect projects already under a signed Proposal. Continued use of the website or Services after changes constitutes acceptance of the new Terms.
